Job Summary
The Legal Officer position is an important role in the legal department of the bank (Herat Branch), performing under the direct supervision of the Head of Legal. This position provides legal assistance for operational banking and attends court matters regarding NPL cases. He/She is responsible for assisting in reviewing agreements, memos, official letters to Government and NGOs, and other legal documents before signing and execution.
Duties & Responsibilities
Major Activities:

1. Banking Operations Legal Support:
- Follow up on legal cases that are under process with the courts, rights department, and other related authorities across Afghanistan.
- Reply to governmental and nongovernmental inquiry letters and official letters in coordination with the legal department.
- Prepare and draft letters for the creation or release of Registered Mortgages (Tazmin Khat).
- Attend court matters regarding registered and relinquishing of Registered Mortgages.
- Assist in providing legal support to the bank’s day-to-day operations based on applicable laws, regulations, policies, and procedures.
- Assist in reviewing legal manuals and reports, court judgments, changes in judicial systems, amendments in various statutes and legislation, promulgation of new laws, regulations, presidential degrees, by-laws, and orders.
- Conduct onsite and offsite assessments of properties that need to come under mortgage against the client’s facilities.
2. Contract Management:
- Assist in reviewing agreements, contracts, and memorandums of understanding before signing and execution.
- Assist in drafting agreements, contracts, memorandums of understanding, and other legal documents as needed.
3. Cooperation & Communication:
- Translate legal documents or any other documents as required by the Head of the Legal Department.
4. Other Related Assignments:
- Perform other duties related to the Legal Department.
Job Requirements
Knowledge:

- Bachelor’s degree in Law, with considerable knowledge of Banking Law, Company Law, legal principles and practices, legal drafting principles, and Afghanistan’s Legal System and functioning of courts.
Skills and Abilities:

- Familiarity with the Legal System of Afghanistan, specifically knowledge of Banking Law and other regulations related to the corporate and banking sector of the country.
- Computer-literate, fluent in both written and spoken English, and the official languages of the country (Dari and Pashto).
- Research and investigative skills are required.
- Understanding of State Laws and Regulations; ability to identify potential problem areas and appropriately assist the Legal Manager as needed.
- Ability to review and understand complex legal documents and prepare responses/documents accordingly.
- Strong organizational, prioritization, analytical, written, and verbal communication skills.
- Proficient in the use of IT applications and systems, including familiarity with Microsoft Office.
- Proven ability to meet stringent deadlines and adapt to changing priorities in a fast-paced and dynamic environment.
- Excellence in drafting; ability to present information in written and oral form clearly and effectively.
- Ability to define problems, collect relevant information, and apply relevant legal principles to factual situations.
